1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of pulpexplosion.com and any purchases you make from Robots, Ninjas, & Monkeys, LLC (“Pulp Explosion,” “we,” “us,” or “our”). By using our store or placing an order, you agree to these Terms. If you don’t agree, please don’t use the store.

These Terms should be read together with our Privacy Policy, Shipping Policy, and Returns & Refund Policy, which are incorporated here by reference.

2. Eligibility

You must be at least 18 years old, or have the involvement of a parent or guardian, to make a purchase or create an account. By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method you submit.

3. Your Account

If you create an account, you’re responsible for keeping your login credentials confidential and for all activity that happens under your account. Let us know promptly at account@pulpexplosion.com if you suspect any unauthorized use. We may suspend or close accounts that violate these Terms.

4. Products, Descriptions, and Pricing

We do our best to describe and display our products accurately, but we don’t guarantee that descriptions, images, colors, or other content are error-free, and printed colors may vary slightly from your screen.

All prices are listed in USD and are subject to change without notice. In the event a product is listed with an incorrect price or description, we reserve the right to refuse or cancel any order placed for that product, even after the order is confirmed. If we cancel an order for this reason, we’ll notify you and issue a full refund.

We may also limit or refuse orders, including where we suspect fraud or reseller activity that violates these Terms.

5. Orders and Payment

When you place an order, you authorize us (through our payment processor) to charge your payment method for the total amount, including shipping and any applicable taxes. Your order is an offer to buy; a confirmation email acknowledges receipt of your order but does not guarantee acceptance. A contract is formed only when we ship your order. We’re not obligated to fulfill orders we don’t accept.

6. Pre-Orders

Some titles are offered as pre-orders before their release date. Pre-order timing is an estimate and may shift if production or release schedules change. Pre-orders are charged at the time the order is placed. If we cancel a pre-order, you’ll receive a full refund. See our Shipping Policy for how pre-orders ship.

7. Shipping, Returns, and Refunds

Shipping timelines, costs, and returns are governed by our Shipping Policy and Returns & Refund Policy. Please review them before ordering.

8. Intellectual Property

All content related to our comics and this store — including characters, storylines, artwork, illustrations, cover art, logos, trademarks, titles, and the text and design of the store — is owned by Robots, Ninjas, & Monkeys, LLC or its creators and licensors and is protected by copyright, trademark, and other laws.

Buying a physical or digital comic gives you the right to read and enjoy it for personal use only. It does not transfer any ownership or intellectual-property rights. You may not reproduce, scan, copy, redistribute, resell for commercial redistribution, publicly display, create derivative works from, or otherwise exploit our characters, artwork, or other content without our prior written permission. Brief quotation or images for reviews, news, commentary, and similar fair-use purposes are welcome.

9. Acceptable Use

You agree not to use the store to break the law, infringe others’ rights, transmit malicious code, scrape or harvest data, interfere with the store’s operation or security, or attempt to gain unauthorized access to our systems or other users’ accounts.

10. Submissions and Feedback

If you send us ideas, suggestions, or feedback, you grant us a non-exclusive, royalty-free, perpetual right to use them without obligation or compensation to you. Please don’t send us confidential material or unsolicited creative work you expect to be kept private or paid for.

11. Third-Party Links

Our store may link to third-party websites or services we don’t control. We’re not responsible for their content, products, or practices, and your use of them is at your own risk.

12. Disclaimer of Warranties

Except as required by law, the store and our products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the store will be uninterrupted, secure, or error-free. Nothing in these Terms excludes any warranty or right that cannot be excluded under the law that applies to you, including consumer-protection rights in your country.

13. Limitation of Liability

To the fullest extent permitted by law, Robots, Ninjas, & Monkeys, LLC and its owners and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the store or our products. Where liability cannot be excluded, our total liability is limited to the amount you paid for the order giving rise to the claim. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Robots, Ninjas, & Monkeys, LLC from any claims, losses, or expenses (including reasonable legal fees) arising out of your misuse of the store or your violation of these Terms or applicable law.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Massachusetts, United States, without regard to its conflict-of-law rules. You agree that any dispute will be handled in the state or federal courts located in Worcester County, Massachusetts, except where the law of your country of residence requires otherwise. Nothing here removes mandatory consumer protections available to you where you live.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Your continued use of the store after changes take effect means you accept the updated Terms.

17. Termination

We may suspend or terminate your access to the store at any time if you violate these Terms. The sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply after termination.
